Job purpose The Negotiations Attorney is part of an Attorney-led team in our Pre-Litigation department and is responsible for all aspects of the second phase of the case including approving demands and negotiating settlements.
This role reports directly to the Pre-Litigation Attorney and works with, but does not directly manage, the Demand Specialist and the Closing Legal Assistant.
Duties and responsibilities Serves as main point of contact for the client through the negotiation phase.
Reviews demands.
Ensures that all bills and records have been received.
Ensures that the case file has updated health insurance itemized liens, and that the charges are all related.
Disputes liens if needed.
Discusses any additional hardships with the client relevant to the case.
Negotiates with insurance adjusters in the best interest of the clients.
Agrees to tentative settlement and requests unsigned release from adjuster.
Assists team with any treatment issues.
Approves supplemental documentation such as prior records or demands.
Makes recommendations regarding cases to refer to litigation department.
Makes recommendations regarding referring cases to outside firms.
Approves settlement checks as needed.
Creates a preliminary worksheet for attorney to approve to qualify the client for settlement.
Reviews cases and any issues regularly with attorney.
Qualifications 2-5 years’ experience, preferably, with personal injury related experience at a high-volume personal injury firm.
Membership in the State Bar Association and a state license to practice law is mandatory.
Willingness and ability to interact with clients, adjusters, and other lawyers/paralegals over the phone and in person.
Willingness and ability to drive accountability.
Bilingual in English and Spanish preferred, medical knowledge is a plus.
Proficient in Microsoft Office, prior experience with Smart Advocate a plus, prior experience with phone systems a plus This position requires a high level of efficiency, attention to detail, and ability to manage others.
Excellent communication skills and the ability to multitask in a high-volume environment.
